Logistics Terms & Conditions

These Terms & Conditions govern all logistics, freight, and cargo services provided by Fastrack Courier & Cargo, operating under the brand name Fastrack Prime (“Company”, “we”, or “our”), to clients (“you”, “your”, “customer”). By engaging our services, you acknowledge and agree to be bound by these terms. These terms apply to all services, including but not limited to transportation, warehousing, and supply chain management, unless otherwise specified in a written agreement. Any deviation from these terms must be agreed upon in writing by both parties.
Fastrack Courier & Cargo, through its brand Fastrack Prime, is committed to providing reliable and efficient logistics solutions, and these terms are designed to ensure clarity, transparency, and fairness in all our dealings with clients. If you have any questions about these terms, we encourage you to reach out to us before engaging our services.
1. Scope of Services
Fastrack Prime provides a wide range of logistics services, including domestic cargo transportation, third-party logistics (3PL), warehousing, and supply chain management services across India. Our services are designed to cater to businesses of all sizes, from small enterprises to large corporations, ensuring timely and secure delivery of goods.
All services are offered in accordance with applicable laws, including but not limited to the Carriage of Goods by Road Act, 2007, and other relevant regulations in India. The scope of services will be as per the mutually agreed quotation, contract, or service order provided to the customer. This may include specific requirements such as time-sensitive deliveries, bulk shipments, or specialized handling.
We may engage third-party service providers, such as carriers or warehouse operators, to fulfill our obligations. In such cases, the terms of service of those third parties may also apply, and Fastrack Courier & Cargo will ensure compliance with these terms.
2. Bookings & Service Requests
Service requests must be made through official communication channels, which include:
- Email communication to our designated email address
- Phone calls to our official customer service numbers
- Website forms available on our official website
- In-person requests at our authorized branches in India
All bookings are subject to confirmation and availability of resources, including vehicles, manpower, and warehouse space. Upon receiving a service request, Fastrack Prime will provide a confirmation within 24-48 hours, depending on the complexity of the request.
The Company reserves the right to refuse or reschedule services based on operational or regulatory conditions, such as:
- Unavailability of transport vehicles due to high demand
- Regulatory restrictions, such as road transport bans or curfews
- Operational constraints, such as vehicle maintenance or staff shortages
In the event of refusal or rescheduling, the customer will be informed promptly, and alternative solutions will be proposed where possible.
3. Cargo Packaging & Labeling
It is the client’s responsibility to ensure that all cargo is properly packaged and labeled to withstand the rigors of transportation and handling. Proper packaging includes using sturdy materials, securing items to prevent movement, and protecting against environmental factors like moisture or impact.
Improper, insecure, or hazardous packaging may lead to:
- Delays in transportation due to repackaging requirements
- Damages to the cargo during transit or handling
- Service refusal by Fastrack Prime to ensure safety
Special handling requirements, such as fragile items, heavy machinery, or oversized cargo, must be clearly communicated in advance. For example, if the cargo requires palletization, temperature control, or specific loading equipment, the customer must inform us at the time of booking.
All packages must be labeled with the following details:
- Consignor and consignee names and addresses
- Contact numbers for both parties
- Contents of the package, especially if hazardous
- Handling instructions, such as "Fragile" or "This Side Up"
Failure to comply with packaging and labeling requirements may result in additional charges for repackaging or handling, which will be borne by the customer.
4. Documentation
The customer must provide accurate and complete documentation to facilitate the smooth execution of logistics services. Required documents may include:
- Commercial invoices detailing the value and description of goods
- Transport permits for restricted or regulated items
- E-way bills (if applicable) as per GST regulations
- Packing lists specifying the contents of each package
- Product declarations for hazardous or sensitive goods
Fastrack Prime will not be held responsible for any delays, penalties, or legal issues arising from missing or incorrect documentation. For example, if an e-way bill expires during transit due to incorrect information provided by the customer, any resulting fines or delays will be the customer’s responsibility.
We strongly recommend that customers verify all documentation with their legal or tax consultants before handing it over to us. Fastrack Prime may assist in obtaining certain documents, such as e-way bills, at the customer’s request and for an additional fee.
5. Transit, Delivery & Delays
Transit time estimates provided by Fastrack Prime are based on normal operating conditions and are not guaranteed unless explicitly agreed upon in writing. For example, a standard delivery from Mumbai to Delhi may take 48-72 hours under normal circumstances, but this is subject to change.
Fastrack Prime is not liable for delays caused by factors beyond our control, including:
- Adverse weather conditions, such as heavy rain, fog, or floods
- Road closures due to accidents, construction, or protests
- Strikes or labor disputes affecting transportation
- Governmental actions, such as lockdowns or transport bans
- Third-party service failures, such as breakdowns by partner carriers
Delivery attempts may be rescheduled in case of consignee unavailability. If the consignee is not available at the delivery address during the agreed time, Fastrack Prime will attempt to contact the consignee. After two failed delivery attempts, additional charges may apply for redelivery or storage.
Customers are advised to ensure that a representative is available at the delivery location to receive the shipment. In case of delays, Fastrack Prime will keep the customer informed through email or phone updates.
6. Liability & Risk
All shipments are transported at the owner’s risk unless insured separately by the customer. Fastrack Prime takes reasonable care to ensure the safe transportation of goods but cannot be held liable for losses or damages under certain circumstances.
Fastrack Prime shall not be liable for:
- Damages due to poor packaging, such as items breaking due to insufficient padding
- Delays beyond our control, as outlined in Section 5
- Pilferage or loss due to unforeseen accidents, such as vehicle collisions
- Losses caused by acts of God, including earthquakes, cyclones, or floods
Any claim for loss or damage must be submitted within 72 hours of delivery, along with proper evidence, such as:
- Photographs of the damaged goods
- A copy of the delivery receipt noting the damage
- An estimated value of the loss or damage
Fastrack Prime will investigate all claims and respond within 7-10 business days. Compensation, if applicable, will be limited to the declared value of the goods or the actual cost of repair, whichever is lower.
7. Insurance
Insurance is not included by default in our standard logistics service unless specifically requested and paid for by the client. Customers are strongly advised to assess the value of their goods and opt for insurance if necessary.
We recommend that clients insure high-value goods via third-party insurance services. Fastrack Prime can facilitate the arrangement of insurance through our trusted partners upon request, subject to additional charges.
In the absence of insurance, the customer assumes full responsibility for any loss or damage to the goods during transit. For example, if a shipment of electronics worth INR 5,00,000 is damaged due to an accident, Fastrack Prime will not be liable unless the shipment was insured.
If the customer opts for insurance through Fastrack Prime, the following terms apply:
- Insurance premiums will be charged based on the declared value of the goods
- Claims will be processed as per the insurance provider’s terms and conditions
- Fastrack Prime will assist in filing claims but is not responsible for the outcome
8. Charges, Payments & Taxes
All services are billed as per the agreed rates, which are determined based on various factors, including:
- Distance between the pickup and delivery locations
- Load capacity, such as weight and volume of the shipment
- Fuel costs, which may vary due to market fluctuations
- Special handling needs, such as refrigeration or oversized cargo
Invoices must be settled within the agreed payment period, typically 15-30 days from the date of invoice, as specified in the service agreement. Late payments may attract interest at a rate of 1.5% per month or as per applicable laws.
Applicable GST and other statutory levies are to be borne by the customer. For example, if the total service charge is INR 10,000, the customer will be responsible for paying the applicable GST (e.g., 18% as per current rates), making the total payable amount INR 11,800.
Payments can be made via bank transfer, online payment portals, or other methods specified by Fastrack Prime. We do not accept cash payments for invoices exceeding INR 50,000, as per regulatory guidelines.
9. Storage & Demurrage
If delivery cannot be completed due to customer fault or delay, such as the consignee being unavailable or refusing to accept the shipment, storage charges may apply after 24 hours. The storage charges will be calculated based on the volume and weight of the shipment, as well as the duration of storage.
Any additional costs due to warehousing, vehicle detention, or handling charges will be invoiced separately. For example:
- If a vehicle is detained at the delivery location for more than 4 hours due to customer delay, detention charges of INR 500 per hour may apply
- Storage charges for a 1-ton shipment may be INR 200 per day after the initial 24-hour grace period
Customers are advised to ensure timely delivery acceptance to avoid such charges. Fastrack Prime will notify the customer of any storage or demurrage charges via email or phone before invoicing.
10. Prohibited Items
The customer shall not ship any prohibited items, which include but are not limited to:
- Explosives, such as fireworks or ammunition
- Hazardous chemicals, such as acids or flammable liquids
- Narcotics and other controlled substances
- Cash, bullion, or precious metals in large quantities
- Illegal substances as per Indian laws
- Perishable or temperature-sensitive goods without prior arrangement
Fastrack Prime reserves the right to inspect, reject, or report such shipments to the appropriate authorities. If prohibited items are discovered during transit, the customer will be liable for any fines, penalties, or legal actions resulting from the shipment.
Customers must declare the nature of their goods accurately at the time of booking. For example, if a shipment contains chemicals, the customer must provide the Material Safety Data Sheet (MSDS) and ensure compliance with hazardous goods regulations.
11. Indemnity
The customer agrees to indemnify and hold harmless Fastrack Courier & Cargo from any liabilities, claims, penalties, or losses arising from:
- Misuse of the service, such as shipping prohibited items
- False declarations, such as understating the value of goods for tax evasion
- Breach of law, such as failure to comply with GST regulations
For example, if a customer ships hazardous materials without proper declaration, resulting in a fine from the authorities, the customer will be responsible for paying the fine and any associated legal costs incurred by Fastrack Courier & Cargo.
This indemnity clause ensures that Fastrack Courier & Cargo is protected from any financial or legal consequences arising from the customer’s actions or negligence.
12. Termination
Fastrack Courier & Cargo reserves the right to terminate service to any customer under the following circumstances:
- Repeated defaults in payment, such as failure to pay invoices for more than 60 days
- Violation of terms or law, such as shipping prohibited items
- Misbehavior or threats to staff or property, such as verbal abuse or physical harm
In the event of termination, Fastrack Courier & Cargo will notify the customer in writing, specifying the reason for termination and any outstanding obligations, such as unpaid invoices. The customer will be required to settle all dues before the termination takes effect.
Termination does not absolve the customer of any liabilities incurred prior to the termination date, such as payment for services already rendered or penalties for non-compliance.
13. Governing Law & Jurisdiction
These terms are governed by the laws of India, including but not limited to the Indian Contract Act, 1872, and the Carriage of Goods by Road Act, 2007. Any disputes arising from these terms or the services provided by Fastrack Courier & Cargo shall be subject to the exclusive jurisdiction of the courts of Ankleshwar, Gujarat.
In the event of a dispute, the parties will first attempt to resolve the matter amicably through negotiation or mediation. If the dispute cannot be resolved within 30 days, either party may approach the courts of Ankleshwar for resolution.
The customer agrees to bear the legal costs incurred by Fastrack Courier & Cargo in defending any claims arising from the customer’s breach of these terms, if the court rules in favor of Fastrack Courier & Cargo.
14. Amendments
Fastrack Courier & Cargo reserves the right to amend these Terms & Conditions at any time to reflect changes in our business practices, legal requirements, or industry standards. Updated terms will be posted on our website and communicated to customers via email where applicable.
Customers are encouraged to review these terms periodically to stay informed of any changes. Continued use of our services after the posting of updated terms constitutes acceptance of the revised terms.
For example, if a new regulation is introduced requiring additional documentation for certain types of cargo, Fastrack Courier & Cargo may update these terms to reflect the new requirement and notify customers accordingly.
