By using the logistics, transportation, and cargo services provided by Fastrack Prime, you agree to be bound by these Terms, as well as our Privacy Policy, Logistics Terms & Conditions, and Payment & Refund Policy displayed on our website. These policies collectively govern your relationship with us.

a. Scope of Agreement

This agreement applies to all clients, including individuals, businesses, and authorized representatives, who engage our services for:

  • Domestic cargo transportation across India
  • Warehousing and inventory management
  • Third-party logistics (3PL) services
  • Supply chain management solutions

For example, if you book a shipment from Mumbai to Delhi or use our warehousing services in Gujarat, you are subject to these Terms.

b. Non-Acceptance

If you do not agree with any part of these Terms or related policies, you must refrain from using our services. Continued use of our services, such as booking a shipment or submitting a quote request, constitutes your acceptance of these Terms.

2. Services Provided

Fastrack Prime offers a comprehensive range of logistics and cargo services designed to meet the needs of businesses and individuals across India. This section outlines the scope of our services and the conditions under which they are provided.

a. Service Offerings

We provide the following services, subject to availability and operational feasibility:

  • Transportation: Domestic cargo transportation by road, including full truckload (FTL) and less-than-truckload (LTL) services
  • Logistics: Third-party logistics (3PL) solutions, including inventory management and order fulfillment
  • Cargo Handling: Loading, unloading, and specialized handling for fragile, oversized, or heavy cargo
  • Warehousing: Short-term and long-term storage solutions in secure facilities
  • Supply Chain Management: End-to-end solutions, including route optimization and delivery tracking

For instance, we can transport a consignment of electronics from Chennai to Kolkata or store your goods in our Ankleshwar warehouse for 30 days while you arrange distribution.

b. Service Conditions

All services are subject to the following conditions:

  • Availability: Services depend on the availability of vehicles, manpower, and warehouse space
  • Location Feasibility: We may not service certain remote or restricted areas due to logistical constraints
  • Prior Booking: All services require advance booking through our official channels (e.g., website, email, phone)

For example, if you request a same-day delivery to a remote area with limited road access, we may need to reschedule or suggest an alternative solution due to feasibility constraints.

c. Third-Party Involvement

We may engage third-party service providers, such as carriers or warehouse operators, to fulfill our obligations. In such cases, the terms of service of those third parties may apply in addition to these Terms, and Fastrack Prime will ensure compliance with our standards.

3. User Obligations

As a user of Fastrack Prime’s services, you have certain responsibilities to ensure smooth operations and compliance with legal requirements. This section outlines your obligations as a client.

a. Accurate Information

You agree to provide accurate and complete information for shipping and billing purposes, including:

  • Consignor and consignee details (e.g., names, addresses, contact numbers)
  • Consignment details (e.g., weight, dimensions, contents)
  • Billing information (e.g., GST number, payment details)

Inaccurate information may lead to delays, additional charges, or service refusal. For example, if you provide an incorrect delivery address, we may incur additional costs to redirect the shipment, which will be billed to you.

b. Compliance with Laws

You are responsible for ensuring that all consignments comply with applicable laws and regulations, including:

  • The Carriage of Goods by Road Act, 2007
  • GST regulations (e.g., providing valid e-way bills)
  • Prohibited items restrictions (as outlined in Section 7)

Consignments containing hazardous, prohibited, or restricted items without proper declaration will be rejected, and you may be liable for any resulting penalties or legal actions.

c. Timely Payments

You agree to pay all dues within the stipulated time as per the invoice or service agreement. Failure to do so may result in:

  • Late payment penalties (as outlined in our Payment & Refund Policy)
  • Suspension of future services until dues are cleared
  • Legal action to recover outstanding amounts

For example, if your invoice specifies a 15-day payment term and you fail to pay within that period, you may be charged a late fee of 1.5% per month on the outstanding amount.

4. Pricing & Payments

We aim to provide transparent pricing for our services. This section details how prices are determined and the payment terms that apply.

a. Pricing Factors

Prices for Fastrack Prime’s services are determined based on the following factors:

  • Consignment Details: Weight, volume, and type of goods (e.g., fragile, hazardous)
  • Distance: The distance between the pickup and delivery locations
  • Fuel Surcharges: Adjustments based on fluctuating fuel prices
  • Tolls and Taxes: Applicable road tolls and GST levies
  • Special Handling: Additional charges for refrigerated transport, oversized cargo, or expedited delivery

For example, transporting a 2-ton shipment from Delhi to Bangalore with special handling for fragile items may cost more than a standard 1-ton shipment due to the additional care required.

b. Payment Terms

Payments must be made as per the terms outlined in the invoice or prior written agreements. Key payment terms include:

  • Standard credit terms of 7-30 days, depending on the service agreement
  • Advance payments may be required for high-value or specialized shipments
  • Accepted payment methods include bank transfer, UPI, and cheque (as detailed in our Payment & Refund Policy)

We will provide a detailed invoice for each service, including a breakdown of charges, taxes, and payment due date. Customers are advised to review invoices promptly and report any discrepancies within 3 days.

c. Late Payment Penalties

Late payments beyond the agreed period will attract penalties as follows:

  • Interest at 1.5% per month on the outstanding amount
  • Potential suspension of services until dues are cleared
  • Additional collection fees if third-party agencies are involved

For instance, if a INR 50,000 invoice remains unpaid for 1 month past the due date, an interest charge of INR 750 will be added to the outstanding amount.

5. Liability & Limitations

While Fastrack Prime takes utmost care to ensure the safe and timely delivery of your consignments, certain circumstances are beyond our control. This section outlines our liability and limitations.

a. Force Majeure

Fastrack Prime is not liable for delays, losses, or damages caused by force majeure events, including:

  • Natural disasters (e.g., earthquakes, floods, cyclones)
  • Strikes or labor disputes affecting transportation
  • Government actions (e.g., lockdowns, road bans)
  • Third-party issues (e.g., accidents involving partner carriers)

For example, if a shipment is delayed due to a nationwide lockdown imposed by the government, Fastrack Prime will not be held liable for the delay, but we will work to reschedule delivery as soon as possible.

b. Limited Liability

Our liability for damage or loss is limited to the declared value of the consignment, provided the value is declared at the time of booking. Key points include:

  • We are not liable for damages due to improper packaging by the customer
  • Compensation will not exceed the declared value or the actual cost of repair, whichever is lower
  • High-value consignments should be insured to cover potential losses

For instance, if a consignment valued at INR 1,00,000 is damaged and the declared value was INR 80,000, our liability will be capped at INR 80,000, subject to investigation.

c. Insurance Recommendation

We strongly advise customers to insure high-value consignments through third-party insurance providers or via Fastrack Prime’s facilitated insurance services (subject to additional charges). In the absence of insurance, the customer assumes full responsibility for any loss or damage.

6. Cancellations & Refunds

Cancellations and refunds are governed by our Payment & Refund Policy. This section provides a brief overview of the process.

a. Cancellation Process

Cancellations must be made in writing at least 24 hours before the scheduled dispatch or pickup, as detailed in our Payment & Refund Policy. Cancellations after this period may not be eligible for a refund due to operational costs incurred.

For example, if you cancel a shipment 12 hours before the scheduled pickup, you may not be eligible for a refund if we’ve already allocated resources such as a vehicle and driver.

b. Refund Eligibility

Refunds are subject to eligibility and service conditions, including:

  • Double or excess payments (e.g., paying INR 30,000 twice for the same invoice)
  • Cancellations within the permissible time frame (e.g., 24 hours before dispatch)
  • Services not rendered due to our operational failure (e.g., failure to pick up a consignment)

Non-refundable charges, such as administrative fees and taxes, will be deducted from the refund amount. Refer to our Payment & Refund Policy for detailed terms.

c. Refund Process

Approved refunds will be processed within 7-10 working days to the original mode of payment. Customers will be notified via email once the refund is processed, along with a transaction reference number.

7. Prohibited Items

Fastrack Prime does not accept certain items for shipping to ensure safety, legality, and compliance with regulations. This section lists prohibited items and the consequences of non-compliance.

a. Prohibited Items List

The following items are strictly prohibited from being shipped through our services:

  • Explosives, firearms, and weapons (e.g., fireworks, guns, ammunition)
  • Narcotics or illegal substances (e.g., drugs, controlled substances)
  • Perishable goods without prior approval (e.g., fresh produce without refrigeration)
  • High-value goods without insurance (e.g., gold, jewelry valued above INR 5,00,000)
  • Hazardous materials without proper declaration (e.g., flammable liquids, toxic chemicals)
  • Counterfeit goods or items violating intellectual property rights

Customers must declare the nature of their goods accurately at the time of booking. For example, if a shipment contains chemicals, you must provide the Material Safety Data Sheet (MSDS) and ensure compliance with hazardous goods regulations.

b. Consequences of Non-Compliance

Fastrack Prime reserves the right to inspect consignments and take the following actions if prohibited items are discovered:

  • Reject the shipment and return it to the customer at their expense
  • Report the shipment to the appropriate authorities (e.g., police, customs)
  • Hold the customer liable for any fines, penalties, or legal actions resulting from the shipment

For instance, if we discover undeclared narcotics in a shipment, we will report it to the authorities, and the customer will be responsible for any legal consequences.

8. Privacy

Your privacy is important to us. This section summarizes how we handle your data in accordance with our Privacy Policy.

a. Data Collection

We collect only the information necessary to deliver our services, such as:

  • Contact details (e.g., name, email, phone number)
  • Shipping details (e.g., consignor/consignee addresses)
  • Payment information (e.g., bank details for invoicing)

For example, we need your address to deliver a shipment and your email to send you a delivery confirmation.

b. Data Protection

We are committed to protecting your data and will never sell, rent, or misuse it. Our data protection practices include:

  • Using secure servers and encryption (e.g., SSL/TLS for data transmission)
  • Limiting access to authorized personnel only
  • Complying with applicable laws, such as the Digital Personal Data Protection Act, 2023 (DPDP Act)

b. Dispute Resolution

In the event of a dispute, the parties will first attempt to resolve the matter amicably through negotiation or mediation within 30 days. If the dispute cannot be resolved, either party may approach the courts of Ankleshwar for resolution.

For example, if there is a disagreement over a shipment’s delivery terms, we will attempt to resolve it through discussion before escalating to legal proceedings.

c. Legal Costs

The customer agrees to bear the legal costs incurred by Fastrack Courier & Cargo in defending any claims arising from the customer’s breach of these Terms, if the court rules in favor of Fastrack Courier & Cargo.
